This page outlines the VCGLR's approach to regulating the gambling and liquor industries.

The VCGLR's Regulatory Approach is our strategy on regulating the gambling and liquor industries to:

  • achieve high levels of voluntary compliance with gambling and liquor laws by setting clear expectations, encouraging the right behaviour and taking strong enforcement action where required
  • constrain the regulatory costs and restrictions we impose on the gambling and liquor industries to what is necessary to achieve regulatory objectives
  • uphold a culture of integrity and harm minimisation in the gambling and liquor industries.
What is our regulatory approach?

The regulatory approach provides a framework to guide our decision making and use of resources. Through the it, we are committed to minimising-harm by focusing our efforts on types of harm our statutory powers are best suited to targeting and concentrating on action that the businesses we regulate can take.

Five overarching principles guide how we regulate:

  • Risk-based - we use risk to guide our activities, the use of our resources and we aim for consistency
  • Proactive - we make independent decisions, identify emerging issues and respond before the community suffers from significant harm
  • Collaborative - we work collaboratively with our regulatory partners, the gambling and liquor industries and the community
  • Transparent - we are open about how we regulate
  • Targeted - we choose proportionate enforcement sanctions that target individual offenders to change their behaviour and secure compliance with gambling and liquor laws for the protection of the community.

Why have a regulatory approach?

Our regulatory approach influences our day-to-day decision-making, our resource allocation and the development of operational tools, policies and guidelines to inform our operations.

It also provides the community, the gambling and liquor industries, our regulatory partners, industry associations and other stakeholders with an understanding of how we approach our work. By making our regulatory approach publicly available, we inform stakeholders on what to expect from us and how to work with us.

We will continually review and update our approach to reflect any significant changes to legislation, government policy or contemporary regulatory practice.

What is risk-based regulation?

Being risk-based is one of the key principles of our regulatory approach. An understanding of risk guides our decision-making, priorities and use of resources in discharging our statutory functions in licensing, information and education, monitoring and enforcement.

We consider the risks associated with activities such as particular kinds of liquor licensed premises or types of gambling as well as the risk presented by individuals and businesses in the gambling and liquor industries. This may include a particular business more likely to be at risk of causing harm to the community or non-compliance with regulatory requirements.

By adopting a risk-based approach, we acknowledge a tolerance of risk is necessary to properly meet our regulatory objectives.

Prosecution Policy

As outlined in its Regulatory Approach, the VCGLR undertakes a targeted enforcement approach and may undertake prosecution of relevant offences. This is to prevent or minimise community-wide harm and ensure individuals and businesses comply with liquor and gaming laws. The VCGLR's Prosecution Policy (DOC, 227KB) outlines the relevant factors and considerations which are taken into account by the VCGLR in deciding whether to exercise its discretion to prosecute various offences as well as the conduct of the prosecutorial function.
