The Victorian Gambling and Casino Control Commission (VGCCC) prepares and publishes decisions and reasons for decisions in relation to certain gaming applications and disciplinary action proceedings.

2018

EGM Increase - Ballarat Golf Club Inc

On 24 December 2018 the Commission made a decision in relation to an application by Ballarat Golf Club Inc to amend its venue operator's licence to vary the number of electronic gaming machines at the approved premises located at 1800 Sturt Street, Ballarat from twenty-eight (28) to thirty four (34).

The Commission granted the application subject to the conditions set out in Appendix A of the decision and reasons for decision.

On 25 February 2021, the Commission granted an application by Ballarat Golf Club Inc. to extend the timeframes contained at clauses 2(a) and 2(d) of Appendix A to its reasons dated December 2018, by nine and eight months respectively.

These clauses now read as follows:
Clause 2(a) “The Works at the Premises (as defined in clause 2(b)) must be substantially completed to the satisfaction of the Victorian Gambling and Casino Control Commission  (the Commission) by 5 December 2021.”

Clause 2(d) “The Commission may, on the request of the Venue Operator, agree to extend the time for the completion of the Works referred to in condition 2(b). The request must be made no later than 5 August 2021. Any request for an extension of time must include an explanation as to why the Works have not been substantially completed."

EGM increase - Geelong RSL Sub-branch Inc

On 10 December 2018 the Commission made a decision in relation to an application by Geelong RSL Sub-Branch Inc to amend its venue operator's licence to vary the number of electronic gaming machines at the approved premises located at Geelong RSL, 50 Barwon Heads Road, Belmont, from forty-two (42) to seventy-two (72).

The Commission released its reasons for decision on 1 February 2019.

The Commission granted the application subject to the conditions set out in Appendix A of the decision.

EGM increase - Altona RSL Sub-branch Inc

On 4 December 2018, the Commission made a decision in relation to an application by Altona RSL Sub-Branch Inc to amend its venue operator's licence to vary the number of electronic gaming machines permitted in the approved premises, the Altona RSL, located at 31 Sargood Street, Altona from fifty-eight (58) to eighty (80).

The Commission released its reasons for decision on 20 December 2018.

The Commission refused the application.

EGM increase - Dandenong Cranbourne RSL Sub-Branch Inc

On 24 September 2018, the Commission made a decision in relation to an application by Dandenong Cranbourne RSL Sub-Branch Inc for amendment of its venue operator's licence to vary the number of electronic gaming machines permitted in the approved premises, the Dandenong RSL, located at 44-50 Clow Street, Dandenong, from sixty-three (63) to seventy-four (74).

The Commission released its reasons for decision on 22 October 2018.

The Commission refused the application.

EGM Increase - Leopold Sportsman's Club Inc

On 8 October 2018, the Commission made a decision in relation to an application under section 3.4.17(1)(b) of the Gambling Regulation Act 2003 by Leopold Sportsman’s Club Inc to amend its venue operator's licence to vary the number of electronic gaming machines permitted in the approved premises located at 135 Kensington Road, Leopold, from thirty-five (35) to forty-two (42).

The Commission granted the application subject to the conditions set out in Appendix A of the reasons.

First Extension Request

On 4 March 2021, the Commission received an application from the Leopold Sportsman’s Club Inc for an extension of time to complete Works at the Premises from 30 July 2021 to 30 December 2022 and to vary the scope of the Works (the majority of the Works at the Premises were to remain the same, albeit in a slightly different format).

On 13 May 2021, the Commission determined to:

  • Extend the time for completion of the building Works until 30 December 2022; and
  • To vary the scope of the Works.
  • Allow a further right to seek an extension of time, provided that the request is made by 30 September 2022.

Second Extension Request

On 26 September 2022, the Commission received an application from the Leopold Sportsman’s Club Inc for a second extension of time to complete the remaining building works at the premises.

The Commission determined to:

  • extend the time for completion of the building works from 30 December 2022 to 30 December 2023; and
  • require that the additional seven (7) EGM’s cease operation from 5pm on 31 December 2022 until Works at the Premises were completed.

For avoidance of doubt, if the Works are completed prior to 30 December 2023 then the operation of the additional EGM’s could recommence at the Premises. If the Works are not completed by 30 December 2023, then the approval to operate the additional EGMs at the Premises will lapse.

EGM increase - Castello Cardinia Hotel Pty Ltd

On 10 September 2018, the Commission handed down its decision in relation to an application under section 3.4.17(1)(b) of the Gambling Regulation Act 2003 by Castello Cardinia Hotel Pty Ltd to amend its venue operator's licence to vary the number of electronic gaming machine permitted in the approved premises, Castello's Cardinia Hotel, located at 108 Princes Highway, Pakenham, from fifty (50) to seventy (70).

The Commission released its reasons for decision on 9 October 2018.

The Commission granted the application subject to the conditions set out in Appendix A of the Decision and Reasons for Decision.

On 29 July 2020, the Commission granted an application by Castello Cardinia Hotel Pty Ltd to extend the time for substantial completion of the Works to be carried out at the Castello's Cardinia Hotel as outlined in the original decision to 10 September 2021.

EGM increase - Castello Powell Hotel Pty Ltd

On 3 September 2018, the Commission handed down its decision in relation to an application under section 3.4.17(1)(b) of the Gambling Regulation Act 2003 by Castello Powell Hotel Pty Ltd to amend its venue operator's licence to vary the number of electronic gaming machine permitted in the approved premises, Powell Hotel, located at 202 Ballarat Road, Footscray, from thirty (30) to forty-seven (47).

The Commission released its reasons for decision on 18 October 2018.

The Commission granted the application subject to the conditions set out in Appendix A of the Decision and Reasons for Decision.

EGM increase - Lynbrook Tavern Pty Ltd

On 31 July 2018, the Commission made a decision in relation to an application under section 3.4.17(1)(b) of the Gambling Regulation Act 2003 by Lynbrook Tavern Pty Ltd to amend its venue operator's licence to vary the number of electronic gaming machines permitted at the approved premises, the Lynbrook Hotel, located at 1-3 Commercial Drive, Lynbrook, from fifty-five (55) to seventy-five (75).

The Commission refused the application.

EGM increase - TTHL Pty Ltd

On 26 June 2018, the Commission made a decision in relation to an application under section 3.4.17(1)(b) of the Gambling Regulation Act 2003 by TTHL Pty Ltd to amend its venue operator's licence to vary the number of electronic gaming machines permitted in the approved premises, Torquay Hotel, located at 36 Bell Street, Torquay, Victoria, from thirty (30) to forty-five (45). 

The Commission granted the application subject to the conditions set out in Appendix A of the reasons.

EGM increase - Darebin RSL Sub-Branch Inc

On 4 May 2018, the Commission made a decision in relation to an application under section 3.4.17(1)(b) of the Gambling Regulation Act 2003 by Darebin RSL Sub-Branch Inc to amend its venue operator's licence to vary the number of electronic gaming machines permitted in the approved premises, the Darebin RSL, located at 402 Bell Street, Preston, Victoria 3072, from sixty-five (65) to eighty (80). 

The Commission granted the application subject to the conditions set out in Appendix A of the reasons.

EGM increase - Werribee Football Club Ltd

On 3 May 2018, the Commission made a decision in relation to an application under section 3.4.17(1)(b) of the Gambling Regulation Act 2003 by Werribee Football Club Limited to amend its venue operator's licence to vary the number of electronic gaming machines permitted in the approved premises, the Tiger's Clubhouse, located at 70 Old Geelong Road, Hopper's Crossing, Victoria 3029, from seventy-five (75) to eighty-five (85).

The Commission granted the application subject to the conditions set out at paragraph 139 of the reasons for decision.

First Extension Request
On 15 October 2020, the Applicant applied for an extension of time from 6 February 2021 until 30 June 2022 (+1 year, 4 months and 24 days). This request was granted on 4 February 2021.

Second extension request
On 8 April 2022, the Applicant applied for a second extension of time from 30 June 2022 until 28 February 2023 (+7 months and 29 days). This request was granted on 30 June 2022.

Third extension request
On 22 December 2022, the Commission received an application from Applicant for an extension of time to substantially complete Works at the Premises from 28 February 2023 to 28 March 2023 (+4 weeks). 

On 24 February 2023, the Commission determined to grant the Application for an extension of time to substantially complete Works at the Premises until 28 March 2023, but required that the additional 10 electronic gaming machines (EGMs) that were the subject of the Original Decision be made unavailable for gaming until the Applicant has fulfilled the obligations set out in condition 2 of the Original Decision. 

EGM increase - Horsham Sports & Community Club Ltd

On 23 April 2018, the Commission made a decision in relation to an application by the Horsham Sports & Community Club Ltd for amendment of its venue operator's licence to vary the number of electronic gaming machines permitted in the approved premises, the Horsham Sports & Community Club, located at 177-181 Baillie Street, Horsham, from seventy-eight (78) to eighty-three (83).

The Commission granted the application subject to the condition set out at paragraph 93 of the reasons.

Premises approval - Station Hotel Officer Pty Ltd

On 1 May 2018, the Commission made a decision in relation to an application by Station Hotel Officer Pty Ltd under section 3.3.4(1) of the Gambling Regulation Act 2003 for approval of the premises, the Officer Hotel, proposed to be located at 1 Station Street, Officer, as suitable for gaming with eighty (80) electronic gaming machines.

The Commission refused the application.

2019

EGM Increase - Monbulk Bowling Club Inc

On 19 August 2019, the Commission made a decision in relation to an application by Monbulk Bowling Club Pty Ltd to amend its venue operator's licence to vary the number of electronic gaming machines at the approved premises located at Monbulk Bowling Club, 11 Moores Road, Monbulk, from thirty (30) to forty (40). The Commission granted the application subject to the conditions set out in Appendix A of the decision and reasons for decision.

The Commission has received an application from Monbulk Bowling Club Inc. for amendment of its venue operator licence to allow an extension of time to complete works at the approved premises, the Monbulk Bowling Club, located at 11 Moore Street, Monbulk (the Premises).

The Commission (Deputy Chair Helen Versey) has granted the application and has extended the time for completion of Stage One Works until 31 January 2021.

First Extension Request
The Commission has received an application from Monbulk Bowling Club Inc. for amendment of its venue operator licence to allow an extension of time to complete Stage One building works at the approved premises, the Monbulk Bowling Club, located at 11 Moore Street, Monbulk (the Premises).

The Commission (Deputy Chair Helen Versey) has granted the application and has extended the time for completion of Stage One building works until 31 January 2021.

Second Extension Request
The Commission has received an application from Monbulk Bowling Club Inc. for amendment of its venue operator licence to reduce the scope of Stage Two building works at the Premises and requested that the Commission exercise its discretion to extend the time for payment of the community contributions due to the impacts of the COVID-19 pandemic.

The Commission (Chair Ross Kennedy) has granted the application and has extend the period of payment for community contributions for the years ending June 2022 and June 2023 and aggregated into a requirement for payment to be made by 30 June 2022.

Third Extension Request
The Commission has received an application from Monbulk Bowling Club Inc. for amendment of its venue operator licence to allow an extension of time to complete Stage Two building works at the Premises. 

The Commission (Commissioner Claire Miller) has granted the application and has extended the time for completion of Stage Two building works until 31 January 2023. The Commission has also determined that it is appropriate to require that the additional ten (10) EGMs cease operation at the Premises during the period of extension granted by the Commission, which is until 31 January 2023.

EGM Increase - Castello Players Hotel Pty Ltd

On 1 August 2019, the Commission made a decision in relation to an application under section 3.4.17(1)(b) of the Gambling Regulation Act 2003 by Castello Players Hotel Pty Ltd to amend its venue operator's licence to vary the number of electronic gaming machines permitted at the approved premises, the Players Hotel, located at 1-5 Scott Street, Dandenong, from twenty-five (25) to fifty (50).

Appeal - Minyip Progress Association Inc

On 15 May 2019, the Commission handed down its decision in relation to an appeal by Minyip Progress Association Inc against a decision to refuse its application to be declared a community or charitable organisation.

The Commission has determined to grant the appeal and declare Minyip Progress Association Inc a community or charitable organisation.

EGM Increase - Hogan's Hotel Pty Ltd

On 9 May 2019, the Commission made a decision in relation to an application by Hogan's Hotel Pty Ltd to amend its venue operator's licence to vary the number of electronic gaming machines at the approved premises located at 92 High Street, Wallan from forty-five (45) to sixty-five (65).

The Commission granted the application subject to the conditions set out in Appendix A of the decision.

EGM Increase - Polish Community Association in Geelong Inc

On 12 April 2019, the Commission made a decision in relation to an application by Polish Community Association in Geelong Inc for amendment of its venue operator's licence to vary the number of electronic gaming machines permitted in the approved premises, the Polish Community Association in Geelong, located at 46-48 Fellmongers Road, Breakwater, from thirty-five (35) to seventy-eight (78).

The Commission released its reasons for decision on 26 April 2019.

The Commission refused the application.

2020

Decision and Reasons - Waurn Ponds Hotel

On 17 November 2020, the Commission made a decision to grant an application by Waurn Ponds Management Pty Ltd to amend its venue operator's licence to vary the number of electronic gaming machines at the approved premises located at 1154 Princes Highway, Waurn Ponds from seventy (70) to eighty-one (81). The Commission granted the application subject to the conditions set out in Appendix A of the decision.

On 24 December 2020, the Commission provided its reasons for determining to grant the application.

Premises Approval - Zahav (Aust) Pty Ltd

On 14 April 2020, the Commission made a decision in relation to an application by Zahav (Aust) Pty Ltd under section 3.3.4(1) of the Gambling Regulation Act 2003 for approval of the premises, Mt Atkinson Hotel, proposed to be located at McKinley Drive, Truganina, as suitable for gaming with sixty (60) electronic gaming machines. The Commission granted the application subject to the conditions outlined at paragraphs 156 and 157 of the Reasons for Decision.

Decision - Clifton Springs Golf Club Inc.

On 14 April 2020, the Commission made a decision to grant an application by Clifton Springs Golf Club Inc. to amend its venue operator's licence to vary the number of electronic gaming machines at the approved premises located at 92-94 Clearwater Drive, Clifton Springs from forty (40) to fifty (50).  

The Commission granted the application subject to the conditions set out in Appendix A of the decision.

First Extension Request

On 13 September 2022, the Commission received an application from the Clifton Springs Golf Club Inc for an extension of time to complete Works at the Premises from 15 December 2022 to 30 June 2023.

On 15 December 2022, the Commission determined to:

  • Extend the time for completion of the building Works until 30 June 2023; and
  • Require that the additional ten (10) EGM’s cease operation from 5pm on 16 December 2022 until Works at the Premises were completed.

For avoidance of doubt, if the Works are completed prior to 30 June 2023 then the operation of the additional EGM’s may recommence at the Premises. If the Works are not completed by 30 June 2023, then the approval to operate the additional EGMs at the Premises will lapse.

Premises Approval - Castello Daisy's Hotel Pty Ltd

On 6 April 2020, the Commission made a decision in relation to an application by Castello Daisy’s Hotel Pty Ltd under section 3.3.4(1) of the Gambling Regulation Act 2003 for approval of the premises, Castello’s Clyde North Hotel, proposed to be located at 1-59 Matterhorn Drive, Clyde North, as suitable for gaming with one hundred (100) electronic gaming machines. The Commission refused the application.

Appeal - Tokens for Humanity Ltd

On 3 February 2020, the Commission handed down its decision in relation to an appeal by Tokens for Humanity Ltd against a decision to refuse its application to be declared a community or charitable organisation.

The Commission has determined to grant the appeal and declare Tokens for Humanity Ltd a community or charitable organisation.
